SECTION 504 OF THE REHABILITATION ACT OF 1973

AMERICAN WITH DISABILITIES ACT OF 1990

 

In accordance with both Section 504 of the Vocational Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990 the Assumption Parish School Board attests that no qualified handicapped person shall, solely by reason of a handicap be denied the benefits of, be excluded from participation in, or be otherwise subjected to discrimination under any program or activity; nor shall a qualified handicapped person be subjected to discrimination in employment.

 

The Assumption Parish School System shall, on an annual basis, provide notice that it adheres to the stated policy and identify the individual designated as 504 Coordinator and an ADA Coordinator.

 

The Assumption Parish School System shall establish PROCEDURAL SAFEGUARDS for the identification, evaluation, or placement of a handicapped student; the employment of a handicapped person; or the accessibility of programs.  These safeguards shall include the right to examine relevant records, an impartial hearing with an opportunity for participation and representation by counsel, and a review procedure.

 

The Assumption Parish School System shall have in place a grievance procedure and shall provide this procedure as a part of due process whenever a Section 504 or ADA issue arises.

 

The Assumption Parish School System shall initiate a self-evaluation relevant to both Acts and shall develop a transition plan for areas in substantial noncompliance with the regulations.  An annual review shall be conducted to assure compliance and assess changing needs.
