EMPLOYEE DRUG AND ALCOHOL USE

 

 

The Assumption Parish School Board recognizes the need to provide a safe and healthful workplace for its employees and the students in their charge.  In order to meet this need as well as comply with federal law, the Board shall adopt and implement a program to prevent employee drug and alcohol abuse.

 

The use, reporting to work under the influence of, bringing onto school premises, possession, transfer, storage, concealment, transportation, promotion or sale of illegal drugs, unauthorized controlled substances, look-a-likes, designer and synthetic drugs, alcohol or intoxicating beverages, (including the presence of any detectable amount in the employee's body while working), and any other drugs or substances which may affect or alter an employee's mood, senses, responses, motor functions, judgment, reactions, perception, performances, while on any school property or off school property during any school sponsored or school approved activity, event, or function, such as a field trip or athletic event, where students are under the jurisdiction of the School Board, is prohibited. Violation of such a prohibition shall result in a complete investigation conducted by the Superintendent or designee.

 

During any investigation, the employee may be suspended with pay.  If the investigation determines that the employee is guilty of the official charge, the Superintendent shall recommend:

 

1.

Taking personnel action against such an employee, up to and including termination; or

 

2.

Requiring such employee to participate satisfactorily in a substance abuse assistance or rehabilitation program.  The program shall meet the approval of the Superintendent or his/her designee and shall be at the employee's expense.  Any illegal substances found in such investigation shall be turned over to the appropriate law enforcement agency.

 

The Board further commits itself to the establishment of a drug free awareness program in order that employees will be informed about:

 

1.

The dangers of drug abuse in the workplace;

 

2.

The Board policy regarding employee use of drugs and alcohol;

 

3.

The community resources available to assist employees in counseling and rehabilitation.

 

4.

The penalties that may be imposed upon employees under this policy.

All employees shall be given a copy of and shall be thereby notified that any employee who is engaged in the performance of duties shall, as a condition of the employment, agree to abide by the terms of this policy and shall further agree to notify the Superintendent or his designee of any criminal drug conviction for a violation occurring in the workplace no later than five (5) days after such conviction.

 

The Superintendent or his/her designee shall implement the terms of this policy within thirty (30) days of conviction.

 

DEFINITIONS:

 

1.

Workplace shall be defined as the site for the performance of work done in connection with any activity under the auspices of the Assumption Parish School Board.

 

2.

Controlled Substance is any substance listed in Schedules I through V of Section 202 of the Controlled Substances Act (21 USC 812) and as further defined by federal regulations 21 CFR 1308.11 through 1308.15.

 

3.

Look-a-like Drug is any tablet, capsule, powder or liquid containing controlled over-the-counter ingredients whose physical appearance resembles various prescription drug products which contain substances regulated under the provisions of the Controlled Substances Act of 1970.

 

4.

Designer (Synthetic) Drugs are those chemical substances that are artificially produced where the molecular structure of both legal and illegal drugs is altered to create a drug that is not explicitly banned by federal law.

 

5.

Official Charge refers to a charge brought by an official of the Assumption Parish School Board.

 

6.

Conviction is a finding of guilt or imposition of sentence or both by any judicial body charged with the responsibility to determine violations of federal or state criminal drug statutes.
